    Terms of Use

    1. 1.

      Introduction

      1. 1.1.

        The Health Promotion Board (“HPB”) in collaboration with the Ministry of Education (“MOE”) and Ministry of Social and Family Development (“MSF”) has launched the website https://parentingforwellness.hpb.gov.sg (the “Parenting for Wellness website”). The Parenting for Wellness website comprises modules offering practical tips and resources to empower parents to build strong parent-child relationships, strengthen their children’s mental well-being, and parent effectively in the digital age. This initiative forms part of HPB’s broader mission to promote health and well-being among Singaporeans. It is still however, incumbent upon individuals and adult caregivers of children to actively engage with and make informed choices concerning their children or legal wards’ personal health and mental well-being.

      2. 1.2.

        Please read the following terms and conditions carefully before using Parenting for Wellness website. These Terms of Use (ToU) apply to Parenting for Wellness website. By accessing and using the Parenting for Wellness website, you acknowledge that you agree to be bound by these ToU as they may be modified and/or amended from time to time. HPB reserves the right to change these ToU at any time at its sole discretion. Amendments shall take effect immediately when posted on Parenting for Wellness website. Your continued use of Parenting for Wellness website thereafter represents your agreement to any such amendments. Information may be changed or updated without notice. HPB has no obligation to update information presented on the Parenting for Wellness website, so information contained herein may be out of date at any given time. HPB may also make improvements and/or changes described in the ToU, including releasing updated versions of Parenting for Wellness website, at any time without notice.

      3. 1.3.

        In these ToU, the terms:

        1. (i)

          “we”, “our” and “us” refer to HPB; and

        2. (ii)

          “you” and “your” refer to you as the user of the Parenting for Wellness website

      Liability

      1. 2.1.

        Parenting for Wellness website and all information contained in it are provided on an “AS IS” and “as available” basis, without any express or implied warranties of any kind, including but not limited to, warranties about the accuracy, completeness, currentness, merchantability, non-infringement or suitability for any purpose of the information in Parenting for Wellness website and without any support or any other services by HPB. The information set out herein and in Parenting for Wellness website is for informational purposes only, and no warranty is made that the information is error free. To the extent permitted under law, HPB excludes all conditions, warranties, representations or other terms which may apply to Parenting for Wellness website, whether express or implied. Please note that once you leave the Parenting for Wellness website or arrive at an application from another non-HPB location, either by using a link we may have provided for your convenience or by specifying your own destination, HPB accepts no responsibility for the content, products and/or services provided at these non-HPB locations. HPB does not control, endorse, promote or have any affiliation with any other website or software application (including mobile applications) unless expressly stated herein.

      2. 2.2.

        HPB does not guarantee that access to Parenting for Wellness website shall be uninterrupted or error free. To the fullest extent permitted by applicable laws, HPB on behalf of its directors, officers, employees, agents, suppliers, licensors and service providers, excludes and disclaims liability for any losses and expenses of whatever nature and howsoever arising including, without limitation, any direct, indirect, general, special, punitive, incidental or consequential damages; loss of use; loss of data; loss caused by a virus; loss of opportunity, business, revenue, income or profit; loss of or damage to property; claims of third parties; or other losses of any kind or character, from or in connection with the following (a) to (d), even if HPB has been advised of the possibility of such damages or losses, arising out of or in connection with the use of Parenting for Wellness or any other website or apps with which they are linked.

        1. a.

          any inaccuracy or incompleteness in, or errors or omissions in the information on Parenting for Wellness website;

        2. b.

          you using, visiting or relying on any statements, opinion, representation or information in Parenting for Wellness website;

        3. c.

          any delay in the operation or transmission, communications failure, Internet access difficulties or malfunctions in equipment or software;

        4. d.

          any breakdown or malfunction of any equipment, system or software used in connection with Parenting for Wellness website, whether belonging to us or not.

      3. 2.3.

        The health information and other information on Parenting for Wellness website are general in nature. It is provided as a public service and for information purposes only. This information does not constitute, nor is it a substitute for, medical advice, legal advice or professional services. In particular, the information regarding mental health and well-being on Parenting for Wellness website is not intended as a substitute for seeing a healthcare professional. Always seek professional help from a healthcare professional if you observe signs of concern for yourself or for the child(ren) you are caring for. Your doctor can provide the necessary medical diagnosis and treatment. Do not rely on the information on Parenting for Wellness website to self-diagnose any mental health conditions. You should never disregard medical advice or delay seeking such advice for yourself or child(ren) you are caring for, because of anything you read on or through Parenting for Wellness website. You should consult with a healthcare professional to determine whether your use of Parenting for Wellness would be safe and/or effective for you. You are expressly prohibited from accessing or using Parenting for Wellness website against medical advice or if doing so might pose any health risk. In this context, you acknowledge that you take full responsibility for the health, life and well-being of yourself, as well as the health, lives and well-being of your family and children (born and unborn, as applicable), and all decisions now or in the future. Your use of Parenting for Wellness website does not constitute or create a doctor-patient, therapist-patient or other healthcare professional relationship between you and HPB. HPB shall not be responsible, under any theory of liability or indemnity, for your use of or reliance on Parenting for Wellness website.

      4. 2.4.

        HPB shall not be responsible for any claims, losses, liabilities, damages, costs or expenses (whether in contract or tort), breach of statutory duty, loss of revenue, loss of profits or otherwise, direct or indirect, even if foreseeable arising from or in connection with your use of Parenting for Wellness website, including, without limitation, any third-party product liability claims, claims that Parenting for Wellness website fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection or similar legislation, and claims with respect to intellectual property infringement.

    3. 3.

      Links to Third Party Websites

      1. 3.1.

        HPB may provide links to other websites, which we believe may be of interest to you, owned and/or operated by third parties who are not related or affiliated to the HPB (“Linked Websites”). The Linked Websites are provided for your convenience and information only, and the inclusion of any Linked Websites does not imply any endorsement or approval of the Linked Websites by HPB.

      2. 3.2.

        HPB does not control or have any supervision over, and is not responsible for, the content, hyperlink, accuracy or privacy policies of any of the Linked Websites and makes no representation or warranty with respect to the content thereof. You use the Linked Websites entirely at your own risk. HPB is not a party to any transaction or arrangement between you and any of the Linked Websites. Your use of the Linked Websites is subject to the terms and conditions of such Linked Websites (if any), in addition to the ToU herein. If there is any inconsistency, the ToU herein shall supersede.

    4. 4.

      Rights and Obligations of the User

      1. 4.1.

        By using Parenting for Wellness website, including registering for an account with us, you represent and warrant that all information provided by you is true, accurate, current and complete to the best of your knowledge and belief.

      2. 4.2.

        We reserve the right to reject your application for an account, suspend your use of or terminate your account at any time without prior notice to you if you are in breach of these ToU or for any other reason as determined by us at our sole and absolute discretion. If your account is withdrawn from Parenting for Wellness website, you may not sign up for it again unless otherwise determined by HPB in its sole discretion.

      3. 4.3.

        Upon successful registration of your account, you, as the account holder:

        1. a.

          agree to keep any login credentials that may be used to access Parenting for Wellness website confidential;

        2. b.

          shall not allow other persons to use your account;

        3. c.

          shall update your account as and when there are any changes to your details; and

        4. d.

          shall notify us immediately if you have any reason to believe that the security of your account has been compromised.

      4. 4.4.

        You are solely responsible for all activities which occur under your account. We are entitled to treat all activities that occur under your account as having been conducted with your knowledge and authority.

      5. 4.5.

        In addition to any other rights HPB has under these ToU and for so long as your account is active, you acknowledge and agree that we shall have the right, at our sole and absolute discretion, without any prior notice to you, to:

        1. a.

          access your account and its contents as and when we consider necessary for specific purposes, including but not limited to, identifying or resolving technical problems with your account;

        2. b.

          block your access to your full account and/or place your account in a dormant state for the purposes of investigating any breaches by you of these ToU, or if we suspect that there is a compromise in the security of your account; and/or;

        3. c.

          suspend, discontinue, remove or disbar you from the use of your account should there be:

          1. i.

            any breaches by you or suspicion of irregular transactions, fraud, in which event, you may be referred to the relevant law enforcement agencies for investigation (where necessary).

          2. ii.

            any suspicion of manipulation of the mechanics of any activity of Parenting for Wellness website. In these ToU, “manipulation” refers to any act, attempt or intentional engagement in practices that subvert, exploit, take advantage of any loophole relating to any Parenting for Wellness website activity or otherwise manipulate the intended functionality, policies, procedures of any part of Parenting for Wellness website.

      6. 4.6.

        You shall not:

        1. a.

          use any of our logos or any of the following names or slogans: 'HPB', 'Health Promotion Board', '保健促进局’,

        2. b.

          hyperlink to any part of Parenting for Wellness website without written permission from HPB;

        3. c.

          reproduce or distribute the content in Parenting for Wellness website (including text, graphics, video, music or sound) to other persons;

        4. d.

          copy any content in Parenting for Wellness website onto another server; make any commercial use of Parenting for Wellness website without the prior written permission of HPB, and then only if all Intellectual Property are kept intact.

        You may not upload, post or email to Parenting for Wellness website or HPB any unlawful, threatening, libellous, defamatory, obscene, scandalous, inflammatory, pornographic, objectionable or profane material, or any other content that could give rise to any civil or criminal liability under the law.

    5. 5.

      Proprietary Rights & Restricted Use

      1. 5.1.

        All intellectual property and rights in the Parenting for Wellness website are protected by law. You may not reproduce or use any part of the site for commercial purposes without prior written permission from HPB except that you are permitted to use the website content for personal and non-commercial purposes only, including family sharing.

      2. 5.2.

        Parenting for Wellness website is not endorsed by, directly affiliated with, maintained, authorised, or sponsored by any companies referenced in Parenting for Wellness website or whose products or services are referenced in Parenting for Wellness website. The use of any third-party trademark, brand name, product name or mark within Parenting for Wellness website is for reference purposes only and does not imply any affiliation with or endorsement by the owner of the trademark, brand name, product name or mark. Any trademark, brand name, product name or mark and any names of related products and services are the trademarks of their respective owners.

      3. 5.3.

        The information you submit to HPB as part of your registration, and any data, text and other material that you may submit or post to Parenting for Wellness website ("User Content") remains your intellectual property, and HPB does not claim any ownership of the copyright or other proprietary rights in such registration information and the User Content. Notwithstanding the foregoing, you agree that HPB may retain copies of all registration information and the User Content and use such information and the User Content as reasonably necessary for or incidental to its operation of Parenting for Wellness website and as described in these ToU and the Privacy Statement.

    6. 6.

      Data

      1. 6.1.

        Information submitted to HPB via Parenting for Wellness website shall be treated in accordance with our Privacy Statement located at https://parentingforwellness.hpb.gov.sg. By signing up for an account on Parenting for Wellness website, you acknowledge and agree to be bound by the Privacy Statement as it may be modified and/or amended from time to time. HPB reserves the right to change the Privacy Statement. Amendments shall take effect immediately when posted on Parenting for Wellness website.

    7. 7.

      General

      1. 7.1.

        In these ToU, unless the context otherwise requires, the headings are inserted for convenience only and shall not affect the construction of these ToU.

        7.2.

        If any provision of these ToU is held to be invalid or unenforceable, then such provision shall (so far as it is invalid or unenforceable) be given no effect and shall be deemed not to be included in these ToU but without invalidating any of the remaining provisions of these ToU.

        7.3.

        No failure or delay by us in exercising any right or remedy provided by law under or pursuant to these ToU shall impair such right or remedy or operate or be construed as a waiver or variation of it or preclude our exercise at any subsequent time and no single or partial exercise of any such right or remedy shall preclude any other or further exercise of it or the exercise of any other right or remedy. HPB’s rights and remedies under or pursuant to these ToU are cumulative, may be exercised as often as it considers appropriate and are in addition to its rights and remedies under general law.

        7.4.

        These ToU are governed by Singapore law, and you agree to submit to the exclusive jurisdiction of the Singapore courts. This submission does not prevent HPB from initiating legal proceedings or enforcing any judgement in any other jurisdiction. Before taking legal action, you must follow a dispute resolution process with HPB, which involves notifying HPB in writing, a 30-day discussion period for negotiation, and, if unresolved, mediation through the Singapore Mediation Centre. Only after these steps may legal proceedings commence, with non-compliance potentially impacting legal rights.

        7.5.

        Please review these ToU periodically on https://parentingforwellness.hpb.gov.sg for the latest changes and updates. To notify you of when these ToU are last revised, please refer to the Effective Date stated below.
